) — Tyler Robinson’s defense team believes the Utah County Attorney’s Office violated the court’s order to not make prejudicial statements to the media and that the judge should impose sanctions.
“I think that the No. 1 remedy in this case is to preclude the state from seeking the death penalty against Mr. Robinson,” attorney Richard Novack told 4th District Judge Tony Graf on Friday.
The judge in the Robinson capital murder case heard about three hours of arguments from both sides on Friday about whether comments made by prosecutor Chris Ballard, the office’s spokesman, to various media organizations nationwide — including TMZ and USA Today — were in violation of the court’s order and if the Utah County Attorney’s Office should be held in

A judge on Monday ordered prosecutors to answer allegations they violated a gag order in the Tyler Robinson murder case, setting the stage for a new legal battle over comments made to national media outlets.
Fourth District Judge Tony Graf Jr. granted Robinson's request for an order to show cause.

asking a judge
to take an unusual step: remove the entire Utah County Attorney’s Office from prosecuting the case.
Their argument centers on a family connection inside the prosecution team and the appearance that it could have influenced the state’s decision to seek the death penalty. Robinson faces an aggravated murder charge stemming from the September 2025 shooting that occurred while a seated Kirk was speaking to a large audience.
