Former Utah Valley University Officer Christopher Bagley said he witnessed Kirk's shooting as the conservative activist spoke to a crowd of thousands last year. Soon after, he went to a nearby gravel rooftop, where it appeared someone had been lying prone with a clear sightline to Kirk's location, Bagley said.
“It looks like a sniper pad,” Bagley said, adding, "you’ve got markings of elbows, knees and feet.”

Utah State Bureau of Investigation Agent David Hull described Tyler Robinson's alleged movements before and after Kirk was killed as prosecutors played previously unseen campus surveillance videos in state court. The defendant first arrived on campus about four hours before Kirk was killed, Hull said.
While the court on Tuesday watched video of Robinson allegedly walking to the roof and lying down, Erika Kirk appeared to be crying and dabbing her eyes.
Prosecutors say they
intend to seek the death penalty
in the case. They are trying to convince Judge Tony Graf that they have enough evidence to bring Robinson to trial on an aggravated murder charge.

State District Judge Tony Graf was seen on camera in a Provo courtroom watching the footage.

The man accused of killing Charlie Kirk allegedly spent hours on the Utah Valley University campus before the shooting, dressed casually in shorts and a T-shirt, purchasing food at Chick-fil-A and interacting with members of Kirk’s staff, an investigator testified Tuesday.
Utah State Bureau of Investigation Agent David Hull outlined Tyler Robinson’s alleged actions before and after Kirk was fatally shot, as prosecutors showed state court previously unreleased campus surveillance footage. According to Hull, Robinson first arrived at the university roughly four hours before the killing.
As the court viewed video that Hull said showed Robinson walking toward a rooftop and lying down, Erika Kirk appeared emotional, crying and wiping her eyes.

PROVO, Utah (KUTV) —As prosecutors continued presenting evidence in the preliminary hearing for Tyler Robinson, the man accused of fatally shooting conservative commentator Charlie Kirk, one of Kirk's closest friends said he came to Utah to stand beside the Kirk family.
Jack Posobiec, a conservative commentator who worked alongside Kirk at Turning Point USA, has attended the proceedings this week in Provo. He said he planned to travel to Utah even before learning Kirk's widow, Erika, and his parents would be in the courtroom.
"I was planning to be here even before we got the news that Erika had decided that she would come as well," Posobiec said. "Just to show support for Charlie and show support for this process, getting the information out, getting the facts out, getting the truth out."

When he learned Kirk's family would attend, he said there was no question he would be there.

PROVO, Utah (KUTV) —As prosecutors continued presenting evidence in the preliminary hearing for Tyler Robinson, the man accused of fatally shooting conservative commentator Charlie Kirk, one of Kirk's closest friends said he came to Utah to stand beside the Kirk family.
Jack Posobiec, a conservative commentator who worked alongside Kirk at Turning Point USA, has attended the proceedings this week in Provo. He said he planned to travel to Utah even before learning Kirk's widow, Erika, and his parents would be in the courtroom.
"I was planning to be here even before we got the news that Erika had decided that she would come as well," Posobiec said. "Just to show support for Charlie and show support for this process, getting the information out, getting the facts out, getting the truth out."

PROVO, Utah (AP) — Utah prosecutors plan to play audio clips in open court Thursday of law enforcement officials interviewing
the roommate
of the man accused of killing conservative activist
Charlie Kirk.
Defense attorneys fought against the public release of the statements from Tyler Robinson's roommate and romantic partner, Lance Twiggs. They said prosecutors would characterize the statements as a confession, undermining Robinson's right to a fair trial if the statements are broadcast by the media.
Robinson is charged with aggravated murder and has not entered a plea. He
turned himself in
a day after the fatal shooting of Kirk, a close ally of President Donald Trump credited with helping galvanize the youth vote for Trump in the 2024 election.
Prosecutors allege Robinson confessed in a note left for Twiggs that read: “I had the opportunity to take out Charlie Kirk and I’m going to take it.” Robinson also allegedly sent a text to Twiggs saying he targeted Kirk because he “had enough of his hatred.”

Erika Kirk appeared visibly emotional as she sat in the Utah courtroom
Erika Kirk came face-to-face with the man accused of murdering her husband in a Utah courtroom on Monday as a preliminary hearing began into the killing of conservative influencer Charlie Kirk.
Tyler Robinson, 23, is accused of aggravated murder, felony discharge of a firearm, obstructing justice and witness tampering following the fatal shooting at Utah Valley University last September.
The five-day hearing will see prosecutors attempt to persuade a judge that there is enough evidence for him to stand trial, where they intend to pursue the death penalty.
Mr Robinson, who handed himself in to police the day after the shooting, has not yet entered a plea to the charges.
Mr Kirk, 31, was delivering a speech on the Orem campus when he was shot dead on September 10, 2025.

Tyler Robinson, the man accused of killing Charlie Kirk, was seen laughing in court while Kirk’s widow, Erika, cried only a short distance away.
Dressed entirely in black, Erika Kirk came face-to-face with her husband’s alleged killer for the first time Monday morning, as Robinson appeared before a Utah judge for the start of a five-day preliminary hearing.
According to the Daily Mail’s reporter inside the courtroom, Erika broke down in tears before proceedings had even begun.
She was joined in court by her rarely seen in-laws, Robert and Kathryn Kirk, as the family gathered for the emotionally charged hearing.

Provo, Utah (CNN) —
The former roommate of Tyler Robinson, the man accused of killing conservative activist Charlie Kirk, told investigators Robinson “said he wishes he hadn’t done it” the day after the fatal shooting.
“He started crying a little bit and said he wishes he hadn’t done it, and then kept going around and just doing stuff, I think to keep himself busy or distracted or something,” the roommate, Lance Twiggs, told prosecutors in a videotaped interview shown in court Thursday, as part of a multiday hearing.
“Eventually he said that he would talk to his parents or turn himself over,” Twiggs said.
Officials testified Robinson surrendered to police later that day.
