The Nagpur District Consumer Disputes Redressal Commission ruled that collecting toll without maintaining roads is a deficiency in service and ordered the National Highways Authority of India (NHAI) to compensate a motorist whose vehicle was damaged by a pothole. The motorist was traveling from Nagpur, Maharashtra to Chhindwara, Madhya Pradesh on October 2, 2020, when his vehicle hit a deep pothole. According to factnewsindia.com, the complainant alleged the pothole damaged the car’s metal wheel rim and dislodged the tyre. DTNext.in reported that NHAI was ordered to pay Rs 1,030 for vehicle repair, Rs 10,000 for mental and physical agony, and Rs 5,000 for litigation costs.

Separately, the Chennai (North) District Consumer Disputes Redressal Commission ordered NHAI to pay Rs 10,000 in compensation for collecting double toll fees due to a non-functioning Fastag scanner. According to newindianexpress.com, on February 20, 2025, at Athur Toll Plaza, staff collected Rs 140 from a commuter, including a Rs 70 penalty, claiming the Fastag account had insufficient balance, though the account had a balance of Rs 863. Fastag receipts submitted as evidence showed the tag had Rs 1,103. Staff at Athur Toll Plaza were aware that the automated Fastag scanner was not functioning.
