PA lawmakers await state Supreme Court ruling on skill games

HARRISBURG — Pennsylvania lawmakers say they’re waiting for the state’s highest court to decide whether skill games are legal before they once again attempt to regulate and tax the machines.
Slot-like skill games exist in a legal gray area and have proliferated across the state in taverns, gas stations, and corner stores. They are one of the legislature’s top contenders for new taxes to raise revenue for transit, education, and other budgetary needs.
Leaders tried to reach a deal on skill games last year, but were stymied by warring gaming interests and lawmakers’ conflicting allegiances to them, particularly in the Republican-led state Senate.
This time around, the GOP senators most supportive of an aggressive tax on the skills industry are newly emboldened, after three members of the caucus
survived bruising primaries
in which skill games interests spent heavily to unseat them.

Pennsylvania Attorney General Dave Sunday is calling a recent Pennsylvania Supreme Court ruling a major victory for consumers and taxpayers after the court determined that so-called "skill games" are illegal under the Commonwealth's current Crimes Code and Gaming Act.
The ruling follows arguments presented by the Office of Attorney General before the state's highest court in November 2025. The office contended that the electronic machines, commonly found in convenience stores, bars, restaurants, and other establishments across Pennsylvania, function as unlicensed and unregulated slot machines.
State attorneys argued that including an element of skill in the games does not exempt the devices from Pennsylvania's gambling laws.
"Today's ruling is a significant victory for consumers, taxpayers and the rule of law in Pennsylvania," Attorney General Sunday said in a statement. The Pennsylvania Supreme Court dropped a bombshell on Monday afternoon, ruling that Pennsylvania Skill games are illegal under the Gaming Control Act.
The state’s highest court said that the skill games are slot machines under Commonwealth law and must adhere to the state’s crime and gambling statutes.
The caveat to the ruling – law enforcement cannot begin for 120 days, providing the General Assembly time to decide on regulating the machines.

HARRISBURG — So-called skill games, the slot-machine lookalikes that have proliferated by the tens of thousands around Pennsylvania bars and corner stores, are slot machines devices and should be regulated as such, the state’s highest court ruled Monday.
The Pennsylvania Supreme Court ruling clears the way for widespread taxation and regulation by the state, as well as limits on where the machines are available, as a majority of justices ruled that both gambling law and the criminal code apply to the machines.
“The device is a ‘slot machine,’” wrote the
newly-independent Justice David Wecht
in the
majority opinion
.
The majority recognized that the ruling could cause a “potential disturbance” for “business owners and other good-faith participants in the industry,” so the ruling will take effect after a 120-day “safe harbor” period. And if lawmakers in Harrisburg disagree with the opinion, the General Assembly “remains free at any time to take whatever legislative action it may deem appropriate.”
