WASHINGTON (TNND) —The Supreme Court on Monday ruled that states can continue counting mailed ballots that arrive after Election Day, rejecting a challenge backed by President Donald Trump and Republicans that sought to tighten ballot deadlines ahead of the 2026 midterm elections.
In a5-4 decisionwritten by Justice Amy Coney Barrett, the court held that federal law does not require mailed ballots to be received by Election Day, so long as states choose to accept ballots that are postmarked by that date. Chief Justice John Roberts joined Barrett and the court's three liberal justices in the majority.
"We must decide whether the federal election-day statutes preempt Mississippi's law," Barrett wrote. "They do not."
The ruling leaves intact laws in more than half the states and the District of Columbia that allow mailed ballots to be counted after Election Day if they were postmarked by Election Day. In many of those states, the extended deadlines apply only to military and overseas voters.

(The Center Square) - The U.S. Supreme Court, in a 5-4 decision on Monday, ruled that states can accept and count mail-in ballots received after the federal Election Day.
The decision comes out of the high court’s ruling in Watson v. RNC, a case challenging Mississippi’s acceptance of mail-in ballots up to five days after Election Day as long as the ballots are postmarked by that day.
Fourteen states and the District of Columbia allow mail-in ballots to be received after Election Day. In Illinois, mail-in ballots can be received up to 14 days after Election Day.
Justices on the high court said the decision in the case was narrowly tailored to recieving mail-in ballots after the federal Election Day. Justice Amy Coney Barrett said the ruling does not affect Congress' ability to regulate federal elections or the practice of absentee voting.

The U.S. Supreme Court has upheld a Mississippi law that allows election officials to count mail-in ballots that are postmarked by Election Day but received up to five days after it.
The ruling is a loss for the Republican Party, which brought the case, ahead of this year's midterm elections.
Eighteen states and territories
, including Mississippi, have such mail ballot grace periods. Most of the states are Democratic-led, including California, Illinois and New York. A dozen additional states have grace periods for ballots returning from overseas, like from military members.
These grace periods have historically provided voters time to get their absentee ballots to officials in case there are any issues with the Postal Service — as well as any other unforeseen issues, such as weather events.

WASHINGTON (AP) —The Supreme Court on Monday ruled that states can count ballots that arrive after Election Day, a persistent target of President Donald Trump.
The decision rejected a Republican-led attack on laws in more than half the states and the District of Columbia that permit mailed ballots to arrive and be counted some number of days after the election, provided they are postmarked by Election Day. The outcome spares officials the headache of changing their ballot rules just a few months before the 2026 midterm congressional elections.
In just over half of those states, the more forgiving deadlines apply only to ballots cast by military and overseas voters.
The legal challenge was part of Trump's broader attack on most mail balloting, which he has said breeds fraud despite strong evidence to the contrary and years of experience in numerous states. Trump has repeatedly claimed that his loss to Joe Biden in 2020 resulted from fraud even though more than 60 court decisions and his own attorney general said that argument had no merit.

The U.S. Supreme Court ruled 5-4 that states can continue to count mailed-in ballots that arrive after Election Day, a practice that has been criticized by President Donald Trump.
The decision prevents a major shakeup in voting rules a few months before midterm elections that will decide control of Congress, among other state and local races. It preserves laws in more than half of the states and D.C. that accept ballots that arrive within a certain period after Election Day, as long as they are postmarked by Election Day.

WASHINGTON—By a 5-4 margin, the U.S. Supreme Court delivered a huge blow to President Donald Trump’s long-running campaign against mail-in voting. The majority ruled that mailed-in ballots postmarked by Election Day but received at local elections boards after that must be counted under deadlines the states set. Trump demanded Election Day itself be the cutoff for any counting.
The decision was one of several important rulings the justices handed down Monday.
Shortly before they announced the ruling on mail-in balloting, they rejected hearing Trump’s appeal of the sex abuse verdict that E. Jean Carroll won for 5 million dollars in 2023.
In another decision important to workers they ruled that Trump could legally fire National Labor Relations Board member Gwynne Wilcox just because he wanted to.
Trump dumped Wilcox, despite the law setting up the NLRB and staggering its members’ terms, along with banning the firing of a member except for cause. Trump said Wilcox, a former Service Employees counsel and the board’s first-ever Black female chair, didn’t genuflect to the administration’s pro-corporate agenda.

WASHINGTON — Rejecting a Republican National Committee challenge, the Supreme Court ruled Monday that election officials may count mail-in ballots that arrive after Election Day if they were postmarked beforehand.

(The Center Square) - The U.S. Supreme Court, in a 5-4 decision on Monday, ruled that states can accept and count mail-in ballots received after the federal Election Day.
The decision comes out of the high court’s ruling in Watson v. RNC, a case challenging Mississippi’s acceptance of mail-in ballots up to five days after Election Day as long as the ballots are postmarked by that day.
Fourteen states and the District of Columbia allow mail-in ballots to be received after Election Day. In Illinois, mail-in ballots can be received up to 14 days after Election Day.
Justices on the high court said the decision in the case was narrowly tailored to recieving mail-in ballots after the federal Election Day. Justice Amy Coney Barrett said the ruling does not affect Congress' ability to regulate federal elections or the practice of absentee voting.

Just over four months before the 2026 midterm elections, the Supreme Court on Monday upheld a Mississippi law that allows mail-in ballots to be counted as long as they are postmarked by, and received within five days of, Election Day. By a vote of 5-4, the justices in
Watson v. Republican National Committee
rejected an argument, made by the political parties and others challenging the law, that federal law requires mail-in ballots to be received by Election Day.
Writing for the majority, Justice Amy Coney Barrett concluded that “the election-day statutes require the electorate’s choice to be made on election day. That occurs so long as election day is the deadline for individuals to vote—as it is in Mississippi. But the election-day statutes do not set a deadline for ballot receipt, so they do not prevent Mississippi from counting ballots postmarked before election day yet received afterward.”
