The U.S. Supreme Court on Monday rejected India-based Tata Consultancy Services' appeal against a $140 million punitive damages order passed by a district court relating to a trade secrets dispute with Epic.
The dispute with electronic health records giant Epic goes back to 2014. In a lawsuit filed nine years ago, Epic alleged the information technology services provider and its subsidiary Tata America International Corporation stole its intellectual property.
Epic had originally
secured a $940 million award
against TCS from a Wisconsin federal jury in 2016 in what was one of the biggest trade secret verdicts in U.S. history. The total damages included $240 million in compensatory damages and $700 million in punitive damages.
Since then, state and federal courts cut those numbers down to $280 million in total damages.

DXC's predecessor Computer Sciences Corp, or CSC, licensed its software to insurance company Transamerica in the 1990s. Its 2019 lawsuit, filed in Dallas federal court, said that Tata hired 2,200 Transamerica employees and used their access to CSC's software and knowledge of its proprietary information to build a competing life-insurance platform.
Tata denied the allegations, told the court that the information at issue was not secret and argued that it accessed the software legally.

The additional provision takes TCS's total

Tata Consultancy Services on Tuesday said it would make provision of additional USD 70 million in the first quarter of fiscal 2027 after the US Supreme Court declined to review a lower court ruling in a legal dispute with Computer Sciences Corporation, now part of DXC Technology. TCS, in the BSE filing, said it has already provided USD 150 million for the matter in its books of accounts in accordance with applicable accounting standards.
