Opposition politician Dr. Kizza Besigye and his co-accused, Hajji Obeid Lutale, have filed a fresh application before the High Court seeking to halt criminal proceedings against them, arguing that alleged violations of their constitutional rights have rendered a fair trial impossible.
The two men, who are facing charges of treason and misprision of treason, contend that their prosecution has been irreparably compromised by what they describe as unlawful abduction, torture, prolonged detention, and prejudicial public statements allegedly made by Chief of Defence Forces (CDF) Gen. Muhoozi Kainerugaba.
In the application, Besigye and Lutale have named Gen. Muhoozi, Col. Peter Ahimbisibwe, Lt. Col. Ephraim Byaruhanga, and the Attorney General as respondents.
Through their legal team, the applicants argue that the circumstances surrounding their arrest, detention, and subsequent prosecution have undermined their constitutional right to a fair hearing and due process.

KAMPALA, Uganda --A court inUgandaon Wednesday charged an attorney for a jailed opposition leader with concealing treason, escalating a dispute with the country's army chief whom the lawyer sought to hold accountable for alleged abuses.
Erias Lukwago was charged before a magistrate's court in Kampala, the Ugandan capital, days after he wasseized and taken into custodyon the orders of army chief Gen. Muhoozi Kainerugaba.
Lukwago was charged with “misprision of treason,” a crime that the presiding magistrate said stems from his alleged failure to report acts of treason by others. He has denied the charges.
Lukwago, the president of the People’s Front for Freedom opposition group, is an attorney forKizza Besigye, a four-time presidential candidate who is jailed overtreason chargesin a separate case that his supporters see as politically motivated. A Kampala magistrate’s court on June 17 charged opposition lawyer Erias Lukwago with misprision of treason, turning one of Uganda’s best-known defense advocates into the latest high-profile target of the security state. Lukwago, the former Kampala mayor and president of the People’s Front for Freedom, had been seized from his Wakaliga home on June 15; he denied the charge and was remanded in custody.

The Uganda Law Society (ULS) and the Law Society of Kenya (LSK) have strongly condemned the charging of former Kampala Lord Mayor and senior lawyer Erias Lukwago with misprision of treason.
They described the prosecution as an attack on the legal profession and the administration of justice. In separate statements issued yesterday, the two bar associations questioned the circumstances surrounding Mr Lukwago's arrest and subsequent prosecution, warning that the case could have a chilling effect on lawyers representing clients in politically sensitive cases.

NAIROBI, June 17 - A prominent Ugandan lawyer representing detained opposition figure Kizza Besigye was charged with a treason-related offence on Wednesday, days after he was arrested by security forces.
The lawyer, Erias Lukwago, is himself a senior figure in the opposition and used to be mayor of the capital Kampala.
He appeared in court and denied the charge of "misprision of treason," or failing to report treason to the authorities, and was remanded in custody.
Lukwago is representing Besigye in a treason trial and in a related case in which Besigye sued the country's military chief Muhoozi Kainerugaba for repeatedly threatening his life on social media.
Kainerugaba is the son of Uganda's President Yoweri Museveni, 81, who won a disputed presidential election in January that extended his four-decade rule.
